The Anspiration for Constitutional Government in Indonesia: A Socio-legal Study of the Indonesian Konstituante 1956-1959
At the park of my career as a professional lawyer the idea of writing this dissertation occured to me. Colleagues and friends wondered why I would risk my position for an uncertain project. It was not easy to explain, but the answer is simple. Long involved in legal aid and human rights work, I was haunted by the question why, after more than forty years of independence, so many Indonesian people stiil suffered from oppression, arbitrainess and indignity.
The promise of independence was to liberate the Indonesian people collectively as a nation and individually as citizens.
And yet soon our governments turned out to be pseudo-democracies that masked authoritation regimes. Even our constitutions, legal instruments for containing and restraining power, in practice merely symbolized the legality from which authoritian governments have sought a measure of legitimacy.
Finally, if this study contributes to an understanding of the painful process towards constitutional government in Indonesia and helps to keep alive the promises of independence, then it has served its purpose.
